Latest Updates:

Following the amendment to World Anti-Doping Code (the ‘Code’) Article 7.4, which came into effect on 1 June, UKAD has amended its Anti-Doping Rules (the ‘ADR’), with these amendments to come into effect on 1 October 2019.

In summary, the changes made are as follows -

Generally, what was referred to as the “Domestic Pool” in the ADR is now referred to as the “Domestic Testing Pool” or the “National TUE Pool”, depending on the context.

Article 1.3(g) – addition of reference to “Domestic Testing Pool” (the definition of which has also been added to the definition section);

Articles 1.4.1 and 1.4.2 now also apply to Domestic Testing Pool Athletes, as well as National Registered Testing Pool (NRTP) athletes;

Articles 1.4.2 and 1.4.3 clarify that they apply if an athlete returns to any sport. 1.4.3(b) means UKAD can request whereabouts from non-NRTP athletes in appropriate circumstances;

Articles 1.6.1 and 1.6.2 - the Rule changes come into effect from 1 October 2019;

Articles 4.2.4, 4.2.5 and 4.4.2, the “Domestic Pool” is renamed the “National TUE Pool” in this context;

Article 5.7.2 now applies to the “Domestic Testing Pool”, rather than the “Domestic Pool”;

Article 7.2.1, 7.2.2 and 7.2.3 have been amended for consistency with Code Article 7.3;

Article 7.3.1 and the definition of “Atypical Finding” are amended to reflect the change made to Code Article 7.4 in June;

Articles 7.7.1(e)(i) and (ii), and 7.8.1, clarify the B Sample process;

Article 7.7.4, amended for clarity;

Article 13.4.1, adds the concomitant appeal right for Domestic Testing Pool athletes now caught by Article 1.4.2;

Article 13.7.3, adds cross appeals to the National Anti-Doping Panel appeal process;

Article 17.2 has been amended so that written notice provided under the Rules now need only be done by first class post, rather than registered post.

This explains in more detail the reporting instructions for laboratories depending on the concentration of clenbuterol detected in an athlete’s sample and includes the investigative steps that ADOs must follow in such situations.

Please note that this Code change came into effect on 1 June 2019, and it will apply automatically from that date to all cases dealt with under the UK Anti-Doping Rules, pursuant to Article 1.6.2 of those Rules.
